These SMS Terms and Conditions govern the text messaging program operated by Rise Real Estate and its affiliated offices. A complete list of affiliated offices covered by this program appears in the Covered Entities section above.

Program description. Rise Real Estate and its affiliated offices send text messages to individuals who have provided a mobile phone number. Messages relate to real estate services and may include property updates and listing alerts, appointment confirmations and reminders, schedule changes, responses to your inquiries, transaction status updates, and marketing offers.

Consent. Providing a mobile phone number is optional. By providing your mobile phone number, you agree to receive calls, emails, and text messages from Rise Real Estate and its affiliated offices for real estate services at the number you provide, which may be sent using an automatic telephone dialing system or a prerecorded or artificial voice. Consent to receive marketing communications is not a condition of purchasing any goods or services or of qualifying for a loan. You represent that the number you provide is your own and that you are authorized to receive messages at that number.

Terms and Conditions

  1. We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes.

  2. You can cancel the SMS service at any time. Just text “STOP”. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.

  3. If you are experiencing issues with the messaging program, you can reply with the keyword “HELP” for more assistance, or you can get help directly at developer@therise.group.

  4. Carriers are not liable for delayed or undelivered messages.

  5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Any reproduction, modification, distribution, storage, or other use of the Services or any Content for any other purpose is expressly prohibited without prior written permission from us. You shall not sell, license, rent, share, publish, or otherwise exploit any Content outside the Services for commercial use or in any way that violates the rights of any third party.

Managing Communication Preferences

Email subscriptions. We may send email to any email address you provide for informational and marketing purposes. For example, if you save a search, we may send you emails with new homes on the market that match your search. If you save a home, we may keep you posted on status updates such as a price change. When you use our transaction services, we may send you status updates and other information about your transaction. You can manage the types of email you receive by following the instructions included in each email we send you. Please note that even if you unsubscribe from some email subscriptions, we may still need to email you with important transactional or other information.

User Content license grant. By submitting User Content through the Services, you hereby grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable, and transferable license to use, edit, modify, truncate, aggregate, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Content in connection with the Services and our businesses, including for promoting and redistributing part or all of the Services in any media formats and through any media channels, and including after your termination of your Account or the Services. We reserve the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in that case you agree to cooperate with our defense of that claim.

No Warranties

WE PROVIDE THE SERVICES “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE,” AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU.
